The family of Kevin Ward Jr., who was killed in the accident with Tony Stewart in a dirt race at a local dirt track in upstate New York, is suing Stewart.
The family has filed a wrongful death lawsuit against Stewart.
Toxicology reports stated that Ward has marijuana in his system when the horrible incident occured.
The incident occured in upstate New York at Canadaigua Motorsports Park.
Stewart actually missed the next three Sprint Cup Series races after the incident happened.
"Stewart could have easily acted reasonably and with prudence to avoid striking Ward, just as all other drivers had done as they passed Ward during the yellow caution flag," the lawsuit says (via ESPN). "Stewart acted with disregard for Ward's life and safety by driving his vehicle in a manner that would terrorize Ward and thereafter strike, severely injure and kill Ward."
