Tony Stewart's attorney, Brian Gwitt in the case between Stewart VS. the Ward family, has stated that "Stewart did not see Ward" as Ward exited his vehicle on August 9th of last year at Canadaigua Motorsports Park in Orange County, New York.
On said date, Ward exited his No. 13 sprint car, and walked down the track. He was run over by Stewart. Supposedly, according to Gwitt, Stewart was unaware of Ward's presence on the racing surface until just before the collision, and that he did not know who he had hit until after the incident.
"Stewart did not see Ward Jr., or anyone else walking on foot on the track until just prior to contact, and did not know the identity of the person walking on the track until afterwards."
The document fromm Gwitt also states that the toxicology report of Ward's body shows that Ward was on marijuana during the incident. Last year, the district attorney said that the Marijuana impaired Ward's judgement.
